1. Scope of Application
These terms and conditions (AGB) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activities. An entrepreneur is a natural or legal person or a legal partnership that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.

2. Contracting Party, Contract Conclusion, Correction Options
The purchase contract is concluded with Besenecker & Werner GbR.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text
The available language(s) for the conclusion of the contract: German, English.

We store the contract text and send you the order details and our terms and conditions in text form. You can view the contract text in our customer login area.

4. Delivery Conditions
In addition to the stated product prices, shipping costs may be incurred. You can find more details about shipping costs in the offers.

We deliver only by shipping. Unfortunately, it is not possible to pick up the goods yourself.

5. Payment
In our shop, you can generally choose from the following payment methods:

Credit Card
When placing the order, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal, PayPal Express
To pay the invoice amount via the PayPal service (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your login credentials, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further instructions during the order process.

Sofort by Klarna
To pay the invoice amount via Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. You will receive further instructions during the order process.

Google Pay
To pay the invoice amount via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, authenticate with your login credentials, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the order process.

Apple Pay
To pay the invoice amount via Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay activated, authenticate with your login credentials, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the order process.

Amazon Pay
To pay the invoice amount via Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be carried out within one banking day after placing the order. A banking day is any weekday except Saturdays, national public holidays, as well as December 24th and 31st of each year. You will receive further instructions during the order process.

Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise regulated below, payment via Klarna requires a successful address and credit check, and payment is made directly to Klarna. Further information is provided for each payment option and in the order process.

Klarna Invoice
The invoice amount is due 14 days after the goods are shipped and the invoice is received.

6. Retention of Title
The goods remain our property until full payment is made.

7. Transport Damage
If goods are delivered with obvious transport damage, please report such errors to the carrier as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, you help us assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees
Legal Right of Liability for Defects

Unless expressly agreed otherwise below, the statutory right of liability for defects applies. The following limitations and shortened periods apply to claims for damages caused by us, our legal representatives, or agents:

In case of injury to life, body, or health
In case of intentional or grossly negligent breach of duty and fraud
In case of breach of essential contractual obligations, whose fulfillment is necessary for the proper execution of the contract and on whose compliance the contracting party regularly relies (cardinal obligations)
As part of a guarantee, if agreed, or
Insofar as the scope of the Product Liability Act is opened.
Limitations for consumers

For the purchase of used goods by consumers, the following applies: if the defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects occurring within one year of delivery may be asserted within the statutory limitation period of two years from delivery.

Customer service: You can contact our customer service for questions, complaints, and claims via email. Unfortunately, due to limited capacity, we generally cannot offer telephone support. However, in urgent cases, we can be reached at the following number to assist as quickly as possible.

9. Liability
We are always fully liable for claims based on damages caused by us, our legal representatives, or agents:

In case of injury to life, body, or health,
In case of intentional or grossly negligent breach of duty,
In case of guarantee promises, if agreed, or
Insofar as the scope of the Product Liability Act is opened.
In case of a breach of essential contractual obligations, whose fulfillment is necessary for the proper execution of the contract and on whose compliance the contracting party regularly relies (cardinal obligations) through slight negligence by us, our legal representatives, or agents, the liability is limited in amount to the foreseeable damage typical for the contract at the time of conclusion.
Otherwise, claims for damages are excluded.

10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
